The Online Course & Workplace Lab Community Membership Terms & Conditions
Hi there, we are Human Side of Tech, Creators of the Employee Experience Design & Human Centered Leadership Online Course and The Workplace Lab Community Membership (herein referred to as “Online Course” or “The Workplace Lab” or “we” or “us”). We’re so excited to work with you!
Before you dive into your Employee Experience Design & Human Centered Leadership Online Course or membership in The Workplace Lab website (Site or Website) and all the awesome benefits that come along with it, we would appreciate you taking some time to read the Membership Terms (Terms) that govern your use of Employee Experience Design & Human Centered Leadership Online Course and The Workplace Lab membership site.
By signing up to Employee Experience Design & Human Centered Leadership Online Course or The Workplace Lab you are agreeing to these terms. If you do not want to agree to these Terms, you should not sign up to be a participant of Employee Experience Design & Human Centered Leadership Online Course or member of The Workplace Lab.
If you are under 18 years old, you need your parents’ permission before becoming a member and gaining access to the Site.
Your Employee Experience Design & Human Centered Leadership Online Course and Workplace Lab membership are non-transferable. You are forbidden to share your username and password with anyone else. You are responsible for all Site usage that occurs in conjunction with use of your username and password. You must use reasonable efforts to keep your username and password confidential.
Membership requires payment of a membership fee, as detailed on the Site’s sign up page. Payment plans are available upon sign up. By signing up for Employee Experience Design & Human Centered Leadership Online Course or The Workplace Lab on a payment plan, you are contractually agreeing to pay each payment on time. After the 14 day refund period, you are responsible for full payment of your membership and may not cancel.We have the right to seek the collection of any unpaid membership fees. Your membership, or access to all content and all areas of the Site, will be suspended or cancelled if we do not receive the fees for your subscription within 5 days of the payment due date.
Employee Experience Design & Human Centered Leadership Online Course
The online course is sold as a one-time at time of enrollment and grants access to the course for 12 months from the date of enrollment.
When enrolling in the course, if you were granted a 2 month free trial of The Workplace Lab, you will be enrolled into our membership community for 60 days at no additional cost. At the end of 60 days you will be converted to a month-to-month membership rate to continue your membership in The Workplace Lab. Month-to-month memberships can be cancelled at anytime by contacting team [at] humansideoftech [dot] com. You have 7 days from the time of being charged for the month to request a refund for the single month. If you contact us more than 7 days after the charge, you will not be eligible for a refund for that month.
The Workplace Lab
Memberships are offered in annual plans, six month membership period and monthly membership payments.
If you signed up for a six month membership but selected a monthly payment plan you are responsible to pay a minimum of six months membership. After completion of your six months membership period you will be moved to a month-to-month agreement, and can cancel at anytime.
For all membership types, you will be notified at the end of your membership period. For all membership types they are on automatic renewal based on your original membership period and rate. We send out notifications prior to when your membership will be renewed with instructions to continue your membership or deactivate your membership. At the end of your membership period, if you are on an automatic renewal and your account is renewed, you still have 14 days from the time of being charged to contact us to cancel and request a full refund for the renewal.
You can ask for a refund of subscription fees under our “Moneyback Guarantee” policy, during the first 14 days of your subscription. Your request must arrive before 11:59PM PST on the 14th day of when you started your membership.
To cancel please send a send written email* answering the following three questions:
- Why do you want to cancel?
- What did you expect to find that you are not getting?
- What course modules and lessons have you completed?
- What live calls or call recordings have you viewed?
*Please also be considerate with your tone and approach to how you submit a request to cancel. We appreciate an effort to be kind in how we engage together, even if you have decided you’d like to cancel. As a small team, please anticipate 24-48 hour response time with cancellation requests.
We do not offer refunds after the 14-day period.
Please Note: If you opted for a 6-month payment plan and you do not request a refund within 14 days, with the required items of evidence at the time of your refund request, you are required by law to complete the remaining payments of your payment plan.
Upon determining that you are entitled to a refund pursuant to this policy, the Company will promptly issue an instruction to its payment processor to issue the refund. The Company does not control its payment processor and will not be able to expedite any refunds.
To further clarify, we will not provide refunds after the 14th day from your date of purchase and all payments must be made on a timely basis. If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Availability and Use
The Employee Experience Design & Human Centered Leadership Online Course and The Workplace Lab website will usually be available 24 hours a day, seven days a week. We may, however, need to interrupt or suspend your access to the Site or the provision of the Site’s services and content for maintenance, technical or other reasons.
When accessing and using the Site and its services and content, you must comply with directions, instructions or protocols posted on the Site.
We are pleased to be able to offer a wide range of exclusive content on the Site for your educational and learning needs, which we aim to regularly add to. The content will be updated, changed or removed from time to time, at our discretion, so we can’t guarantee that specific content will always be available on the Site.
Each item of content (the “Content”) is owned by Human Side of Tech, except when otherwise attributed. We own all other rights in the Site including its design, and look and feel.
Your membership gives you a revocable, non-exclusive license to use the Content for personal purposes. You may not redistribute Content.
You may use, modify and manipulate the worksheets that are part of The Workplace Lab Content for your own use, but you may not redistribute the files or assets.
The trademarks and logos displayed on the Site are, unless otherwise stated, owned by Human Side of Tech and others, and you must not use these without the approval of the relevant owner.
Fair Use and Prohibited Conduct
You are permitted to download Content to your computer as part of your membership, but your membership is subject to a ‘fair use’ policy. Our ‘fair use’ policy requires that your use of the Site and the Content must be fair, genuine and reasonable.
You also must not:
• Use a false email address, impersonate others, or misrepresent your affiliation with others;
• Engage in automatic gathering of information from or through the Site;
• Attempt to interrupt or alter the Site’s operation in any way;
• Use the Site or the Content in a way that violates applicable law, that violates third party intellectual property or other rights, or that is, fraudulent, obscene, offensive, or defamatory; or
• Copy, distribute, transmit, modify or otherwise exploit the Content or any other data or code made available through the Site.
Intellectual Property Complaints
We respect the intellectual property rights of others and require that you do the same. Please contact us at firstname.lastname@example.org if you believe that your intellectual property or other rights are being affected by anything on the Site.
We reserve the right, but are not obliged, to monitor all matter posted to the Site. We are not responsible or liable for material posted by others. We do, however, reserve the right to edit, refuse to post, or to remove matter that in our discretion is objectionable or in violation of these Terms, our policies or applicable law.
You must not upload or post any materials that:
• Restrict or inhibit others’ use or enjoyment of the Site;
• Are false, misleading, fraudulent, unlawful, abusive, harassing, defamatory, obscene, vulgar, or offensive;
• Infringe others’ rights, including privacy or intellectual property rights;
• Slander or otherwise defame The Workplace Lab, Human Side of Tech, or Vanessa Shaw
• Contain a virus, spyware, or other harmful components; or
• Contain commercial solicitation or ‘spam’ of any kind.
We have the right to terminate your access to The Workplace Lab if any of the Terms in this agreement are violated.
Personal information that you disclose may be used by Human Side of Tech, its agents and contractors to enhance your membership and the Site, including marketing activities for the Site.
We may disclose any personal information as necessary to satisfy any law, regulation or government request.
Information We Collect
We collect personal and non-personal information when you provide it to us in the course of signing up as a Member and using our Website. The personal information that we may collect includes: your name, mailing address, phone number, email address, credit card number, and financial information. The non-personal information that we may collect includes your browser type, the URL of the previous website you visited, your ISP, operating system, and your Internet protocol (IP) Address. The non-personal information is not used by us to personally identify you and is not readily usable for that purpose. When you subscribe to our service or otherwise make a purchase through our Website we may collect your name, mailing address, telephone number, credit card number, email address, and other information that we request during the registration process.
In addition, if you communicate with us regarding the Site or any of our services or products we collect any information that you provide to us during the course of our communication.
Our Use of Information for Internal Purposes
We use your personal information primarily for our own internal purposes, such as providing, maintaining, evaluating, and improving our Website and the products and services we offer and sell, to collect credit card payments for subscription fees and other purchases you make, and to provide customer support.
We use the non-personal information we collect to track the use of the Website and to assist us in providing, maintaining, evaluating, and improving our Website and the services and products we offer and sell.
Our Disclosure of Personal Information to Third Parties
We will disclose your personal information to protect or enforce our legal rights and policies, to protect or enforce the legal rights of a third party, or as we in good faith believe we are required to do so by law (such as to comply with a subpoena or court order, for example). We may contract with various third parties who help us provide, maintain and improve the Website and the services we provide and the services and products we offer and sell and such third parties may have access to your personal information in order to perform their services. For example, we use a third party to process payments made to us, and may subcontract out production, analytics, reporting or other operations. We may contract with third-party contractors to help us manage, monitor and optimize our Website and the services and products we offer and sell. We may also use third party contractors to help us measure the effectiveness of our advertising, and communications. Therefore, while we strive to use commercially acceptable means to protect your personal information, we do not guarantee absolute security. We are not responsible
for the unauthorized acts of others and we assume no liability for any disclosure of information due to errors in transmission, unauthorized third-party access (such as through hacking) or other acts of third parties, or acts or omissions beyond our reasonable control.
Reviewing and Changing Your Personal Information
You may obtain a copy of and request that we correct errors in your personal information by emailing us at email@example.com. If you do desire to obtain a copy of your personal information, you will be required to provide proof of your identity. If your personal information changes or if you no longer want to subscribe to or use the Website, you may correct, update or deactivate your personal information and your account through the account management screen. If you wish to deactivate or terminate your subscription you may also contact our customer service.

Opting-Out From Receiving Communications
You may opt-out from having your personal information used for certain purposes.
If you no longer wish to receive any promotional or other communications from us, you may opt-out by following the instructions included in each email communication or by emailing us at firstname.lastname@example.org. Suspension or Termination of Membership
We may, in our discretion, immediately restrict, suspend or terminate your membership and access to the Site if we consider you in breach of these Membership Terms, any other Site rules, or applicable law. We reserve the right to refuse membership in our discretion.
LIABILITY AND DISCLAIMERS
We do not promise that the Content or your access to the Site will be uninterrupted or error-free; and we make no promises regarding your access to, or the results of your access to, the Site or Content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise. We and our affiliates are not liable for indirect, incidental, special or consequential damages, loss of revenue or loss of profits which result from any use of or access to, or any inability to use or access, the Site.
While we do provide access to various experts and professionals, the advice you receive through The Workplace Lab is not a substitution for consultation with professional accounting, tax, or legal advisers. Before making any decision or taking any action, you should consult a professional.
